Terms of Use for Lumina

Introduction and Agreement

Welcome to Lumina. These Terms of Use ("Terms") govern your relationship with the Lumina mobile application, developed and operated by Nascentra Labs ("we," "us," or "our"). By installing or using our application, you acknowledge that you have read, understood, and agreed to be bound by these professional standards. We provide Lumina as a premium, aesthetic tool for personal financial visualization, and we expect our users to interact with it within the bounds of this agreement.

1. Legal Acceptance of Terms

By accessing or using Lumina, you signify your agreement to these Terms. This constitutes a legally binding contract between you and Nascentra Labs. If you are using the app on behalf of an entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree, you must immediately delete the application.

2. Description of the "Lumina" Service

Lumina is a software utility designed to provide an aesthetic, fluid-based representation of financial flows. We provide a platform for you to organize your personal data; however, we do not function as a bank, brokerage, or licensed financial institution. The service is intended for organizational and visualization purposes only.

3. No Financial Advisory Relationship

The information presented within Lumina, including any "vortex" projections or "flow" dynamics, does not constitute professional financial, investment, or legal advice. We are not your financial advisors. You should consult with a certified professional before making significant financial decisions based on the visualizations in this app.

4. User Ownership of Local Data

We acknowledge that you own all data you input into Lumina. Because we utilize a local-only storage model, you are solely responsible for the maintenance, backup, and security of that data. We cannot be held liable for the loss of data due to hardware failure, software bugs, or accidental deletion by the user.

5. Intellectual Property Rights

All software code, visual designs, "Fluid Vessel" animations, "Category Vortex" logic, and the "Lumina" trademark are the exclusive intellectual property of Nascentra Labs. We grant you a limited license to use these assets through the app, but you do not acquire any ownership rights over our proprietary technology or branding.

6. Limited Use License

We grant you a non-exclusive, non-transferable, revocable license to use Lumina for your personal, non-commercial use on a device that you own or control. This license is granted subject to your compliance with these Terms and can be terminated by us if these Terms are violated.

7. Prohibited User Conduct

You agree that you will not: (a) Attempt to decompile, reverse-engineer, or dissemble the application; (b) Use the app to facilitate any illegal financial activities; (c) Bypass any security features we have implemented; or (d) Modify the application to remove any branding or attribution to Nascentra Labs.

8. Disclaimer of Warranties

Lumina is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, whether express or implied, including the implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that the app will be error-free or that the fluid animations will be perfectly accurate under all hardware conditions.

9. Limitation of Liability

To the maximum extent permitted by international law, Nascentra Labs shall not be liable for any indirect, incidental, special, or consequential damages. This includes, but is not limited to, loss of profits, loss of data, or financial discrepancies resulting from your use of the application. Our total liability is limited to the amount you paid to us (if any) to use the app.

10. Indemnification

You agree to defend, indemnify, and hold harmless Nascentra Labs and its developers from and against any claims, damages, obligations, losses, or expenses arising from your use of the application or your violation of these Terms.

11. Subscription and Premium Features

If we offer "Zen" or "Pro" features via an in-app subscription, those payments are processed through the platform's app store (e.g., Apple App Store or Google Play). We do not manage your billing cycles or refunds directly; those are subject to the terms and conditions of the respective platform provider.

12. Modification of the Terms

We reserve the right to update these Terms at any time to reflect changes in the law or our service. We will notify users of significant changes by updating the "Last Updated" date at the top of this document. Continued use of the app following such changes constitutes your acceptance of the new Terms.

13. Service Termination

We reserve the right to cease support for Lumina or terminate your access to the application at our sole discretion, without notice, if we believe your conduct violates these Terms or is harmful to the integrity of the Nascentra Labs brand.

14. Governing Law and Dispute Resolution

These Terms are governed by general international commercial principles and the laws of the jurisdiction in which Nascentra Labs is registered, without regard to conflict of law rules. Any disputes shall be settled through binding arbitration or good-faith negotiation via our official contact at nascentra@gmail.com.
